Diese Teilnahme- und Datenschutzhinweise (nachfolgend zusammenfassend bezeichnet als "Teilnahmebedingungen") gelten für die Teilnahme an unseren auf sie verweisenden Gewinnspielen und Wettbewerben (nachfolgend bezeichnet als "Gewinnspiel").
Die Teilnahmebedingungen enthalten Regeln für die Teilnahme, Hinweise zu den Gewinnen, zur Gewährleistung und zur Verarbeitung der Daten der Teilnehmer und deren Widerspruchs- sowie Widerrufsrechten.

Ausschluss von Mitarbeitern und anderen Beteiligten: Von der Teilnahme ausgeschlossen sind unsere Mitarbeiter sowie Kooperationspartner und Mitarbeiter von Kooperationspartnern (nachfolgend zusammenfassend "Beteiligte"), die mit der Erstellung oder Abwicklung dieses Gewinnspiels beschäftigt sind oder waren, als auch deren nahe Angehörige, sofern diesen die vorgenannte Einbeziehung der Beteiligten in das Gewinnspiel bekannt war oder hätte bekannt sein müssen.

Bestimmung der Gewinner: Die Gewinner werden per Zufallsauswahl bestimmt.

Gewinnerbenachrichtigung und Gewinnanspruch
Die Gewinner werden zeitnah über den angegebenen Kontaktweg benachrichtigt (z.B., E-Mail oder das Nachrichtensystem eines sozialen Netzwerks, falls es angegeben wurde oder das Gewinnspiel innerhalb des Netzwerks stattfindet).
Die Teilnehmer können um Rückmeldung und Abholung oder anderweitige Geltendmachung der Gewinne innerhalb einer angemessenen Frist gebeten werden. Im Fall der Verhinderung bitten wir um eine Rückmeldung, damit wir, sofern möglich und zumutbar, einen alternativen Termin vereinbaren können.
Die Teilnehmer sind für die Richtigkeit der angegebenen Kontaktdaten verantwortlich. Falls Gewinner aufgrund unvollständiger oder falscher Kontaktdaten nicht benachrichtigt werden können, entfällt der Gewinnanspruch.
Eine Auszahlung der Gewinne in bar oder in Sachwerten, deren Tausch oder Übertragung auf andere Personen ist, vorbehaltlich anderer Angaben oder Zusagen, nicht möglich.

Gewinnspiele innerhalb von Online-Plattformen
Findet das Gewinnspiel innerhalb einer Online-Plattform oder eines sozialen Netzwerks (z.B. Facebook oder Instagram, nachfolgend bezeichnet als "Online-Plattform“) statt, gelten zusätzlich die nachfolgenden Bestimmungen.
Die Teilnehmer können gegenüber der Online-Plattform keine Ansprüche geltend machen, die im Zusammenhang mit der Teilnahme am Gewinnspiel oder dessen Nutzung entstehen. Die Teilnehmer erkennen an, dass das Gewinnspiel in keiner Weise von der Online-Plattform gesponsert, unterstützt oder organisiert wird, bzw. in keiner Verbindung zu der Online-Plattform steht. Alle Informationen und Daten, die im Rahmen des Gewinnspiels durch die Teilnehmer mitgeteilt oder von diesen erhoben werden, werden nur uns und nicht der Online-Plattform bereitgestellt. Wir bitten darum, sämtliche Anfragen und Hinweise bezüglich des Gewinnspiels an uns und nicht an die Online-Plattform zu richten.
Sofern wir Daten der Teilnehmer auf Grundlage von deren Erlaubnis oder einer anderen gesetzlichen Berechtigung von der Online-Plattform erhalten, erfolgen die Nutzung, die Speicherung und die sonstige Verarbeitung dieser Daten nur zu den im Rahmen des Gewinnspiels genannten Zwecken (z.B., wenn wir die E-Mailadresse der Nutzer in ein Gewinnspielformular voreintragen können).
Sollten Teilnehmer zur Eingabe von Zugangsdaten aufgefordert werden, dann werden diese Daten von dem Anbieter der Online-Plattform verarbeitet. Wir erhalten insbesondere keinen Zugang zu den Passwörtern der Teilnehmer.
Neben diesen Teilnahmebedingungen wird das Verhältnis zwischen uns, dem Teilnehmer und der Online-Plattform durch die Geschäftsbedingungen der jeweiligen Online-Plattform bestimmt. Weitere Informationen zu dem Einwilligungsvorgang, Informationen über erteilte Einwilligungen sowie Möglichkeiten, diese zu widerrufen, ergeben sich aus den Datenschutzhinweisen der Online-Plattform.

Hinweise zur Gewährleistung und Haftung
Wir weisen darauf hin, dass es sich bei dem Gewinnspiel und den Gewinnen um freiwillige Leistungen unsererseits handelt, für die nicht derselbe Gewährleistungs- und Haftungsumfang, wie z.B. bei einem vom Gewinnspiel unabhängigen Erwerb der Gewinne gilt.

Beschränkungen der Gewährleistung für Gewinne: Wir haften, vorbehaltlich eigenen Verschuldens nach Maßgabe der Regelungen in den Haftungshinweisen dieser Teilnahmebedingungen, nicht für gewonnene Sachen und Leistungen, die nicht von uns selbst angeboten werden. Im Übrigen gelten die Gewährleistungs- und Garantiebedingungen der jeweiligen Anbieter der Sachen und Leistungen, sofern diese die Teilnehmer nicht einschränken und von uns auf die Teilnehmer übertragen werden können.

Einstellung oder Einschränkung des Gewinnspiels: Wir weisen darauf hin, dass die Verfügbarkeit und die Funktion des Gewinnspiels nur im Rahmen der Zumutbarkeit für uns und die Teilnehmer gewährleistet werden kann. Das Gewinnspiel kann von uns jederzeit beendet werden, insbesondere aufgrund von äußeren Umständen und Zwängen. Zu den äußeren Umständen und Zwängen gehören vor allem technische Probleme, gesetzliche Änderungen oder nicht in unserem Einflussbereich liegende und zwingende Maßnahmen Dritter.
Abweichungen bei Gewinnen: Die im Rahmen der Gewinnspielbeschreibung gezeigten Gewinne können von den, den Gewinnern überreichten Sachen oder Leistungen abweichen, sofern sie im Hinblick auf die beschriebenen Gewinne aus der Sicht eines durchschnittlichen Teilnehmers gleichwertig sind. Nach dieser Maßgabe können Abweichungen hinsichtlich Modell, Farbe, Lokalität o. ä. bestehen.

Haftungshinweise: Für unsere Haftung auf Schadensersatz gelten unbeschadet der sonstigen gesetzlichen Anspruchsvoraussetzungen die folgenden Haftungsausschlüsse und Haftungsbegrenzungen.
Soweit die Haftung unsererseits ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung von unseren Arbeitnehmern, Vertretern und Erfüllungsgehilfen. Wir haften für die leicht fahrlässige Verletzung von wesentlichen Pflichten, deren Verletzung die Erreichung des Vertragszwecks gefährdet, oder für die Verletzung von Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Gewinnspiels überhaupt erst ermöglicht und auf deren Einhaltung die Vertragspartner regelmäßig vertrauen (sog. Kardinalspflichten). In diesem Fall haften wir jedoch nur für den vorhersehbaren, vertragstypischen Schaden. Wir haften nicht für die leicht fahrlässige Verletzung der in den vorstehenden Sätzen genannten Pflichten durch andere. Wir haften unbeschränkt, soweit die Schadensursache auf Vorsatz oder grober Fahrlässigkeit beruht. Im Fall grob fahrlässiger Pflichtverletzung durch unsere Erfüllungsgehilfen gelten die vorgenannten Einschränkungen für die leicht fahrlässige Verletzung von wesentlichen Pflichten.
Die vorstehenden Haftungsbeschränkungen gelten nicht bei Verletzung von Leben, Körper und Gesundheit, für einen Mangel nach Übernahme von Beschaffenheitsgarantien für die Beschaffenheit eines Produktes und bei arglistig verschwiegenen Mängeln. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

Rechtsweg: Der Rechtsweg ist im Hinblick auf die Ziehung der Gewinner und die etwaige Beurteilung der eingereichten Gewinnspielbeiträge ausgeschlossen.

Datenschutzhinweise
Wir verarbeiten personenbezogene Daten der Teilnehmer von Gewinnspielen und Wettbewerben nur unter Einhaltung der einschlägigen Datenschutzbestimmungen, soweit die Verarbeitung zur Bereitstellung, Durchführung und Abwicklung des Gewinnspiels erforderlich ist (Art. 6 Abs. 1 S. 1 lit. b. DSGVO), die Teilnehmer in die Verarbeitung eingewilligt haben (Art. 6 Abs. 1 S. 1 lit. a DSGVO) oder die Verarbeitung unseren berechtigten Interessen dient (z.B. an der Sicherheit des Gewinnspiels oder am Schutz unserer Interessen vor Missbrauch durch mögliche Erfassung von IP-Adressen bei Einreichung von Gewinnspielbeiträgen).
Die Daten der Teilnehmer werden nur dann an andere Stellen übermittelt, wenn dies für die Durchführung des Gewinnspiels erforderlich ist (z.B. Zwecks des Versandes von Gewinnen) oder ein Teilnehmer in die Übermittlung eingewilligt hat.
Wir weisen die Teilnehmer im Rahmen des Gewinnspiels darauf hin, welche ihrer Angaben für die Teilnahme erforderlich sind.
Die Daten der Teilnehmer werden gelöscht, sobald das Gewinnspiel oder der Wettbewerb beendet ist und die Daten nicht mehr erforderlich sind, um die Gewinner zu informieren oder weil mit Rückfragen zum Gewinnspiel zu rechnen ist. Grundsätzlich werden die Daten der Teilnehmer spätestens 6 Monate nach Ende des Gewinnspiels gelöscht. Daten der Gewinner können länger einbehalten werden, um z.B. Rückfragen zu den Gewinnen zu beantworten oder die Gewinnleistungen zu erfüllen; in diesem Fall richtet sich die Aufbewahrungsdauer nach der Art des Gewinns und beträgt z.B. bei Sachen oder Leistungen bis zu drei Jahre, um z.B. Gewährleistungsfälle bearbeiten zu können. Ferner können die Daten der Teilnehmer länger gespeichert werden, z.B. in Form der Berichterstattung zum Gewinnspiel in Online- und Offline-Medien.
Sofern Daten im Rahmen des Gewinnspiels auch zu anderen Zwecken erhoben wurden, richten sich deren Verarbeitung und die Aufbewahrungsdauer nach den Datenschutzhinweisen zu dieser Nutzung (z.B. im Fall einer Anmeldung zum Newsletter im Rahmen eines Gewinnspiels).
Soweit wir im Übrigen Ihre Daten verarbeiten oder zusätzliche Informationen zu der Verarbeitung Ihrer Daten bereithalten, geben wir einen Link zu unserer Datenschutzerklärung an und verweisen auf diese.
Den Teilnehmern stehen als Betroffene nach der DSGVO verschiedene Rechte zu, die sich insbesondere aus Art. 15 bis 18 und 21 DS-GVO ergeben:
• Widerspruchsrecht: Sie haben das Recht, aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten, die aufgrund von Art. 6 Abs. 1 lit. e oder f DSGVO erfolgt, Widerspruch einzulegen; dies gilt auch für ein auf diese Bestimmungen gestütztes Profiling. Werden die Sie betreffenden personenbezogenen Daten verarbeitet, um Direktwerbung zu betreiben, haben Sie das Recht, jederzeit Widerspruch gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten zum Zwecke derartiger Werbung einzulegen; dies gilt auch für das Profiling, soweit es mit solcher Direktwerbung in Verbindung steht.
• Widerrufsrecht bei Einwilligungen: Sie haben das Recht, erteilte Einwilligungen jederzeit zu widerrufen.
• Auskunftsrecht: Sie haben das Recht, eine Bestätigung darüber zu verlangen, ob betreffende Daten verarbeitet werden und auf Auskunft über diese Daten sowie auf weitere Informationen und Kopie der Daten entsprechend den gesetzlichen Vorgaben.
• Recht auf Berichtigung: Sie haben entsprechend den gesetzlichen Vorgaben das Recht, die Vervollständigung der Sie betreffenden Daten oder die Berichtigung der Sie betreffenden unrichtigen Daten zu verlangen.
• Recht auf Löschung und Einschränkung der Verarbeitung: Sie haben nach Maßgabe der gesetzlichen Vorgaben das Recht, zu verlangen, dass Sie betreffende Daten unverzüglich gelöscht werden, bzw. alternativ nach Maßgabe der gesetzlichen Vorgaben eine Einschränkung der Verarbeitung der Daten zu verlangen.
• Recht auf Datenübertragbarkeit: Sie haben das Recht, Sie betreffende Daten, die Sie uns bereitgestellt haben, nach Maßgabe der gesetzlichen Vorgaben in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten oder deren Übermittlung an einen anderen Verantwortlichen zu fordern.
• Beschwerde bei Aufsichtsbehörde: Sie haben ferner nach Maßgabe der gesetzlichen Vorgaben das Recht, bei einer Aufsichtsbehörde, insbesondere in dem Mitgliedstaat Ihres gewöhnlichen Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes, wenn Sie der Ansicht sind, dass die Verarbeitung der Sie betreffenden personenbezogenen Daten gegen die DSGVO verstößt.

Details on the conditions for participation, actions to be taken, the duration of the competition, individual sections of the competition and any prizes may additionally be derived from the descriptions provided to the participants within the context of the competition. These detailed descriptions take precedence over these Terms of Participation.

Exclusion of employees and other Involved Parties: Excluded from participation are our employees as well as cooperation partners and employees of cooperation partners (hereinafter collectively referred to as "Involved Parties") who are or were involved in the creation or execution of this competition, as well as their close relatives, insofar as they were or should have been aware of the aforementioned involvement of the Involved Parties in the competition.

Notification of Winners and Entitlement to a Prize
Winners will be notified in a timely manner through the specified contact channel (e.g., email or social network messaging if specified or if the competition is held within the network).
Participants may be asked to provide feedback and pick up or otherwise claim prizes within a time limit. In the event of inability to comply, please contact us so that we can make an alternative appointment, if possible and reasonable.
The participants are responsible for the correctness of the contact data provided. If winners cannot be notified due to incomplete or incorrect contact data, the prize is forfeited.
It is not possible to pay out the prizes in cash, in kind, which may be exchanged or transferred to other persons, subject to other information or agreements.

Competitions within Online-Platforms
If the competition takes place within an Online-Platform or a social network (e.g. Facebook or Instagram, in the following referred to as "Online-Platform"), the following provisions apply additionally.
Participants may not assert any claims against the Online-Platform that arise in connection with participation in and use of the competition. Participants acknowledge that the competition is in no way sponsored, supported or organised by the Online-Platform, nor is it connected to the Online-Platform in any way. All information and data provided by or collected from entrants in the context of the competition will be provided only to us and not to the Online-Platform. We kindly ask you to address all enquiries and comments regarding the lottery to us and not to the Online-Platform.
If we receive participant data from the Online-Platform on the basis of their permission or another legal authorisation, this data will only be used, stored and otherwise processed for the purposes specified in the competition (e.g. if we can pre-enter the e-mail address of the user in a competition form).
If participants are requested to enter access data, this data will be processed by the provider of the Online-Platform. In particular, we do not have access to the passwords of the participants.
In addition to these conditions of participation, the relationship between us, the participant and the Online-Platform shall be governed by the terms and conditions of the respective Online-Platform. Further information on the consent process, information on consents given and possibilities to revoke such consents can be found in the data protection information of the Online-Platform.
Information on Warranty and Liability
We would like to point out that the competition and the prizes are voluntary services on our part, which are not subject to the same scope of guarantee and liability as, for example, the purchase of prizes independent of the competition.
Warranty limitations for Prizes: We shall not be liable, subject to our own fault in accordance with the provisions of the liability notices in these conditions of participation, for goods and services won which are not offered on the market by ourselves. In all other respects, the warranty and guarantee conditions of the respective providers of the items and services shall apply, provided that these do not restrict the participants and can be transferred by us to the participants.
Termination or Restriction of the Competition: We would like to point out that the availability and function of the competition can only be guaranteed within the scope of reasonability for us and the participants. The competition may be terminated by us at any time, in particular due to external circumstances and constraints. External circumstances and constraints include, but are not limited to, technical problems, legal changes or mandatory measures by third parties beyond our control.

Differences of Prizes: The prizes shown in the description of the competition may differ from the goods or services presented to the winners, provided that they are equivalent in terms of the prizes described from the point of view of an average participant. According to this, deviations in model, color, locality, etc. may exist.

Notice of Liability: The following disclaimers and limitations of liability shall apply to our liability for damages, notwithstanding the other statutory conditions for claims.
Insofar as our liability is excluded or limited, this shall also apply to the personal liability of our employees, representatives and vicarious agents. We shall be liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper performance of the competition and on the compliance with which the contracting parties regularly rely (so-called cardinal obligations). In this case, however, we shall only be liable for the foreseeable damage typical of the respective legal realtionship. We shall not be liable for the slightly negligent breach of obligations other than those specified in the preceding sentences. We shall be liable without limitation if the cause of the damage is based on intent or gross negligence. In the case of grossly negligent breach of duty by our vicarious agents, the aforementioned restrictions to the slightly negligent breach of essential obligations shall apply.
The above limitations of liability shall not apply in the event of injury to life, limb or health, in the event of a defect following the granting of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. The liability according to the product liability law remains unaffected.
Legal Recourse: There is no legal recourse with regard to the drawing of the winners and any evaluation of the entries submitted in the competition.

Privacy Information
We process the personal data of participants in We process personal data of participants in competitions, contents, raffles, prize-draws or sweepstakes (hereinafter referred to as "competitions") only in compliance with the relevant data protection regulations and if the processing is necessary for the provision, execution and handling of the competition (Article 6 (1) (b) GDPR), the participants have consented to the processing (Article 6 (1) (a) GDPR) or the processing serves our legitimate interests (e.g. in the security of the competition or the protection of our interests against misuse by possible recording of IP addresses when submitting entries to the competition according to (Article 6 (1) (f) GDPR).
The participant's data will only be transmitted to other parties if this is necessary for the execution of the sweepstakes and competitions (e.g. for the purpose of sending prizes) or if a participant has consented to the transmission.
In the context of the competition, we inform the participants which of their data are required for participation.
The data of the participants will be deleted as soon as the competition has ended and the data is no longer required to inform the winners or because questions about the competition can be expected. In general, the data of the participants will be deleted at the latest 6 months after the end of the competition.
